1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَعَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنِ ابْنِ مَحْبُوبٍ عَنْ جَمِيلِ بْنِ صَالِحٍ عَنْ أَبِي عُبَيْدَةَ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ كَانَتْ لَهُ ثَلاثُ بَنَاتٍ أَبْكَارٍ فَزَوَّجَ وَاحِدَةً مِنْهُنَّ رَجُلا وَلَمْ يُسَمِّ الَّتِي زَوَّجَ لِلزَّوْجِ وَلا لِلشُّهُودِ وَقَدْ كَانَ الزَّوْجُ فَرَضَ لَهَا صَدَاقَهَا فَلَمَّا بَلَغَ إِدْخَالُهَا عَلَى الزَّوْجِ بَلَغَ الرَّجُلَ أَنَّهَا الْكُبْرَى مِنَ الثَّلاثَةِ فَقَالَ الزَّوْجُ لأبِيهَا إِنَّمَا تَزَوَّجْتُ مِنْكَ الصُّغْرَى مِنْ بَنَاتِكَ قَالَ فَقَالَ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) إِنْ كَانَ الزَّوْجُ رَآهُنَّ كُلَّهُنَّ وَلَمْ يُسَمَّ لَهُ وَاحِدَةٌ مِنْهُنَّ فَالْقَوْلُ فِي ذَلِكَ قَوْلُ الأبِ وَعَلَى الأبِ فِيمَا بَيْنَهُ وَبَيْنَ اللهِ أَنْ يَدْفَعَ إِلَى الزَّوْجِ الْجَارِيَةَ الَّتِي كَانَ نَوَى أَنْ يُزَوِّجَهَا إِيَّاهُ عِنْدَ عُقْدَةِ النِّكَاحِ وَإِنْ كَانَ الزَّوْجُ لَمْ يَرَهُنَّ كُلَّهُنَّ وَلَمْ يُسَمِّ وَاحِدَةً عِنْدَ عُقْدَةِ النِّكَاحِ فَالنِّكَاحُ بَاطِلٌ.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad and Ali ibn Ibrahim has narrated from his father all from ibn Mahbub from Jamil ibn Salih from abu ‘ Ubaydah who has said the following: “About the case of a man who has three virgin daughters and gives one of them in marriage to a man without identifying the girl for the husband or to the witnesses. The husband assigns a mahr (dower) for her. At the time for him to meet the girl he is informed that it is the oldest girl. He then says to the father, ‘I married the youngest of your daughters.’ Abu Ja’far (a.s.), has said, ‘If the husband had seen them and did not identify one of them the words of the father are accepted between him and Allah to give in marriage the girl that he had intended at the time forming marriage terms. If the husband had not seen all of them and had not identified any one of them at the time of forming the terms of marriage, the marriage then is invalid.’”
